Golden Hour Data Systems, Inc.: The Federal Court in the Eastern District of Texas has issued a Permanent Injunction against emsCharts and enjoined it and other persons from infringing against Golden Hour Patent 6,117,073.
Specifically, emsCharts and its officers, directors, agents, and employees are enjoined from "making, using, selling, or offering to sell emsCharts software having the ability to export billing data in a format used to transfer data to third-party billing software, including AIM, RescueNet Billing, and Sweet-Billing" or any similar software or file formats.
In addition, emsCharts and its officers, directors, agents, and employees are enjoined from "making, using, selling, or offering to sell emsCharts software having the ability to import flight information relating to an emergency transport crew dispatch or export data to flight dispatch software" or any similar software or file formats.
"I would like to thank the Court for its careful attention to this important matter," said Dr. Kevin Hutton, Chairman and CEO of Golden Hour.
This Permanent Injunction was expected following the recent ruling and $8.2 million dollar Judgment against emsCharts earlier this month for direct, induced, and willful infringement. The Court will also be hearing evidence as to post-verdict damages including the number of infringing air and ground transports as well as establishing a reasonable royalty rate for ground transports. The current owners of emsCharts are Peter Goutmann, John Massie, and the University of Pittsburg Medical Center's (UPMC) Center for Emergency Medicine, owners of the STAT MedEvac medical transportation program.
